Please read this Agreement carefully before accessing, purchasing products or services or using any part of the Website. By accessing or using any part of the web site, you fully agree to become bound by the terms and conditions of this agreement.

CartoonSelf’s services are creates caricatures, cartoon portraits, full characters and animated caricature from your picture. We also feature a Cartoon Gift Shop with products provided through the Amazon Affiliates Program.

Payment

All payments are made through our Stripe payment system to insure safety of your funds. As a client you are expected to pay once you desire your order to begin production. Due to the type of service and cost of labor all sales are final. All payments through Amazon are not handled by Cartoonself.com they are managed through Amazon.

Product/Service Production and Delivery

As a customer if you purchase the "Cartoon Portrait" package you will receive your images in a .png file. As a customer if you purchase the "Full Character" package you will receive your images in a .png file of both the cartoon portrait and full character. As a customer if you purchase the "Animated Caricature" you will receive an Animated Caricature of your full character. In addition to purchasing the "Animated Caricature" package you will receice your images in a .png file of both the cartoon portrait and full character. All orders will be handled promptly and if all information received is accurate and clear the order will be delivered in 24 business hours or less. Their may be instances where the delivery process could take longer, in those cases we will notify you as soon as possible. As a client you may be required to respond to all production emails in order for your product or service to be delivered. All requests must be family & work safe. We reserve the right to refuse any purchase made at any time for any reason. All products or services purchased through our Gift Shop is handled by Amazon, this means all shipping/payment/delivery concerns through Amazon please contact an Amazon support agent.

Copyright

As a client all images, illustrations, cartoons, caricatures and animated caricature you receive you retain 100% ownership. We respect the intellectual property of others, and we ask you to do the same. We will not be held responsible if a client requests us to work on an existing copyrighted image, picture or photo.

Limitation of Liability

In no event will CartoonSelf.com, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to CartoonSelf.com under this agreement during the twelve (12) month period prior to the cause of action. CartoonSelf.com shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

Changes

CartoonSelf.com reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. CartoonSelf.com also reserves the right modify the price of their products or services at any time. CartoonSelf.com may also, in the future, offer new services, products and/or features through the Website (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of this Agreement.

Disclaimer of Warranties

The Website is provided "as is". CartoonSelf.com hereby disclaims all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. CartoonSelf.com makes no warranty that the Website will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, the Website at your own discretion and risk.

Indemnification

You agree to indemnify and hold harmless CartoonSelf.com, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.

Miscellaneous

This site (excluding any linked sites) is controlled by us from our offices within the New York, United States of America. It can be accessed from all 50 states, as well as from other countries around the world. As each of these places has laws that may differ from those of New York, by accessing this site both of us agree that the statutes and laws of the State of New York, without regard to the conflicts of laws principles thereof and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this site and the purchase of products and services available through this site. Each of us agrees and hereby submits to the exclusive personal jurisdiction and venue any court of competent jurisdiction within the State of New York with respect to such matters. Any cause of action brought by you against us or our Affiliates must be instituted with one year after the cause of action arises or be deemed forever waived and barred. You may not assign your rights and obligations under these Terms of Use to any party, and any purported attempt to do so will be null and void. We may free assign our rights and obligations under these Terms of Use. In addition to any excuse provided by applicable law, we shall be excused from liability for non-delivery or delay in delivery of products and services available through our site arising from any event beyond our reasonable control, whether or not foreseeable by either party, including but not limited to, labor disturbance, war, fire, accident, adverse weather, inability to secure transportation, governmental act or regulation, and other causes or events beyond our reasonable control, whether or not similar to those which are enumerated above. If any part of these Terms of Use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.
